But attorneys for Halliburton and its former subsidiary, KBR Inc., argued against it.

What a load of CR*P!
Lawyers arguing that CRIMES committed against an employee would 'qualify' as a 'claim' made by an employee against the company???
How can anyone call themselves a lawyer when they so blatantly defy law along with common sense??
That is getting close to the ULTIMATE of SLEAZE and IMMORALITY, not to mention CRIMINAL.

When I was in college and frat boys would rape a girl, the student paper would be outraged at the guys but within a week the frat's national rep would show up and THE GIRL would be the one to have to leave the school.
EVERY TIME.
It's the same guys all growed up into rapist creeps and employed by friends and associates of Cheney and the Bushes.

"Both sides have involved the public's interest in this incident and at this point the only thing that is clear is that someone is lying about something that is very important to us all. Our citizens are being employed by KBR to collect huge amounts of our tax dollars. We are the ones paying for this and we have a right to know whether KBR is screwing over its employees on this contract or is an employee making stuff up. However it shakes out the guilty party should be exposed so the whole tax-paying public will know who the guilty party is. And that guilty party should well and truly get it in the neck."

I hate to say it, but she did sign an arbitration agreement. People need to be careful of what they sign. These arbitration agreements are bad. If you trade stock through a broker you probably have one too.

I'm not defending the acts by any means. I used this case as an example for my students to understand the danger of signing arbitration agreements. I've seen people get screwed over through arbitration and that's why all of the mega-companies love it.
This news article is about civil liability for what may be criminal acts. She hired her own lawyers to prosecute her private/civil claim. What we're talking about here is basically a sexual harassment claim.
I feel badly for her, but once again, people need to be careful about what they agree to. These arbitration agreements are upheld and enforced the same as waiver of liability provisions.
I think the only hope she has of avoiding arbitration is to make a contractual argument - that she didn't understand the terms, that it was adhesionary or she signed it under duress.

RAPE does not qualify as any sort "arbitration" in ANY employer/employee relationship or policies or 'agreements'!
The men that raped her committed a CRIME, not just a 'policy' violation of any employee 'rules'!
Rape IS against the law - PERIOD! And on top of that, it is vile and violent and despicable.

I'm not sure how you do things down in the U.S. but there are civil cases and criminal cases up here. If you sign an agreement it would likely be for civil actions against the company, if the judge who is hearing this case can't see the difference between the two the judge must have sh*t for brains. If the company cannot be held responsible for this they should provide the names of the people who carried out the rape and they should be charged, If KBR refuses to provide the names then they should be charged.
AS for settling out of court, what is the price of a rape.

Funny how it is Haliburton we are talking about.
They have been raping the US economy and its citizens. With their offshore affiliates underpinning the infrastructure of Iran, and refusing to pay taxes.
